By accessing or using Who Better? at whobettersports.com ("the Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.
The service
Who Better? is a sports comparison tool that lets you stack any two athletes or teams against each other using publicly-available statistics, and a community debate layer where users can share takes on those comparisons.
Accounts
The Service doesn't require traditional accounts. When you post, an anonymous device identifier ties your posts together so you can manage and delete them. You may pick a nickname and emoji for display; both are public.
Your content
You retain ownership of what you post. By posting, you grant Who Better? a non-exclusive, worldwide, royalty-free license to host, display, and distribute your posts within the Service. You can revoke this license at any time by deleting your post.
You agree not to post content that:

Harasses, threatens, or targets individuals or groups.
•
Is illegal, defamatory, or infringes someone's rights.
•
Spams, advertises, or otherwise pollutes the debate.
•
Promotes wagering, gambling, or interpretation of stats for financial decisions — see the disclaimer below.
•
Impersonates a real person or organization in a way that could mislead other users.
Moderation
We reserve the right to remove any content and to restrict or terminate access for any user at any time, with or without notice, particularly for violations of these Terms.
Stats accuracy
Statistics shown in the Service are sourced from publicly- available APIs (primarily ESPN). We don't generate or warrant their accuracy. Stats may be incomplete, outdated, or in rare cases incorrect. The Service is for entertainment and discussion — not for fantasy advice, sports betting decisions, or any other use that would suffer from data inaccuracies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHO BETTER? AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD $50.
Intellectual property
The Who Better? name, logo, brass-scale brand mark, layout, and software are owned by us. Sport league names, team names, and player likenesses are the property of their respective owners and are used here for identification and commentary only.
Changes to these terms
We may update these Terms occasionally. Material changes will be reflected in the "Last updated" date above. Continued use after an update constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Georgia, and you consent to that jurisdiction and venue.
